These Terms of Service (“Terms”) govern your access to and use of simplyfitandhealthy.com, the Simply Fit & Healthy meal-planning web application, What Should I Eat?, Simply Swap™, and other websites, features, content, products, and services that link to these Terms (collectively, the “Services”).

Throughout these Terms, “Simply Fit & Healthy,” “we,” “us,” and “our” refer to Simply Fit & Healthy. “You” and “your” refer to the person accessing or using the Services.

You are responsible for reviewing AI-generated information before relying on or acting upon it.

Simply Fit & Healthy does not guarantee the accuracy, completeness, reliability, suitability, or availability of AI-generated content.

4. Nutrition Information

Calories, protein, carbohydrates, fat, serving sizes, and other nutritional information displayed through the Services may be estimates.

Actual nutritional values may differ based on:

5. Weight-Management Information

Some features may allow you to select goals such as “Lose Weight.”

This selection is used to influence the types of meal suggestions generated by the Services. It does not constitute a personalized weight-loss program, medical recommendation, or guarantee of weight loss.

Results vary among individuals. Simply Fit & Healthy does not promise or guarantee any particular weight, health, fitness, or wellness outcome.

6. Food Allergies and Dietary Restrictions

Simply Fit & Healthy may allow you to enter food allergies, dietary preferences, or foods you wish to avoid.

These features are provided as convenience tools only.

We do not guarantee that any recipe, recommendation, ingredient, substitution, product, or AI-generated response is allergen-free or appropriate for a particular allergy or medical condition.

AI systems may fail to recognize an allergen, cross-contact risk, alternate ingredient name, manufacturing practice, or other relevant information.

If you have a food allergy or intolerance:

8. Simply Swap™

Simply Swap™ is designed to provide alternative foods, ingredients, portions, preparation methods, or meal ideas that may better align with a selected wellness goal.

Simply Swap™ suggestions are not guarantees of improved health, weight loss, disease prevention, or any particular outcome.

Users remain responsible for deciding whether a suggested substitution is appropriate for their individual circumstances.

9. Usage Limits and Availability

Simply Fit & Healthy may impose limits on certain features, including AI-powered meal generation and Simply Swap™.

Limits may be based on factors such as daily usage, browser information, cookies, technical information, account status if accounts are introduced, or other reasonable methods.

We may change usage limits from time to time.

We do not guarantee uninterrupted access to the Services. Features may occasionally be unavailable because of maintenance, technical problems, third-party service interruptions, usage limits, AI availability, security concerns, or other circumstances.

10. Acceptable Use

You agree not to:

• Use the Services for unlawful or fraudulent purposes.
• Attempt to bypass, defeat, manipulate, or circumvent usage limits or security controls.
• Use automated systems, bots, scripts, scraping tools, or similar methods to access the Services excessively or without authorization.
• Interfere with or disrupt the operation or security of the Services.
• Attempt to gain unauthorized access to systems, accounts, data, or infrastructure.
• Introduce malicious code or harmful technology.
• Copy, reproduce, scrape, republish, or commercially exploit substantial portions of the Services except as permitted by law or with our written permission.
• Misrepresent your affiliation with Simply Fit & Healthy.

We may restrict or terminate access where reasonably necessary to protect the Services, users, or our business.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Simply Fit & Healthy and its owners, affiliates, representatives, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful misuse of the Services or material violation of these Terms.
